New Jersey Marijuana Possession Lawyer Adam M. Lustberg Explains Diversionary Programs for Marijuana Charges

The lawyer mentions that simple possession of marijuana is considered a disorderly person offense in New Jersey. If someone is convicted of simple possession of fewer than 50 grams of marijuana, having a skilled marijuana attorney is very important.

If you’re a first-time offender, you may qualify to participate in a diversionary program or Drug Court. This can help you avoid incarceration and allow your record to be expunged after completion of drug treatment, a probation period, and community service performance,” says the New Jersey marijuana possession lawyer.

The lawyer explains that a second offense for possession of marijuana may have more severe penalties. However, having a skilled lawyer who knows how to prepare an aggressive defense against additional drug convictions is very important.

Attorney Adam M. Lustberg adds that if one is charged with possession of 50 grams of marijuana, the charge will be classified as a disorderly person offense under N.J.S.A 2C:35-10(a). Other charges are NJSA 2C:35-10(b) – using or being under the influence of CDS, NJSA 2C:35-10 (c) - failure to deliver CDS to police, and NJSA 2C:36-2 – possession of drug paraphernalia.

Lustberg adds that if a person of convicted of the aforementioned drug charges, they may be required to pay a $500 “drug enforcement reduction” and up to a $1000 fine. Mandatory license suspension is also required and depending on the discretion of the court, a two-year probation period may be imposed.

According to the defense attorney, “There are defense strategies that may prevent conviction. For instance, you have constitutional rights against unlawful search and seizure. If an illegal search of your property is conducted by law enforcement, the charges can potentially be challenged with the goal of getting them dismissed. And if it can be proven that the reason you were stopped and detained in the first place was illegal, your simple possession of marijuana charges can potentially be thrown out.”
