Tax Exempt Does Not Mean Law Exempt

Tax Exempt Does Not Mean Law Exempt

The words "nonprofit hospital" inspire trust. Many nonprofit institutions provide indispensable care. But nonprofit status is a legal structure, not permission to ignore laws that otherwise apply.

Public Benefit and Public Responsibility
A nonprofit hospital still needs revenue, pays employees, buys equipment, borrows money and can produce a financial surplus. "Nonprofit" does not mean "no money." Tax exemption likewise does not mean immunity from antitrust, fraud, reporting, employment, patient-safety or other laws.

The Problem of Many Regulators
Healthcare is watched by many authorities. Tax agencies administer tax law. Competition authorities enforce antitrust rules. Healthcare agencies administer federal payment programs. States regulate insurance, facilities, professions and charities.

A single insurer-provider transaction may raise accounting, tax, reimbursement and competition questions at the same time. If each agency sees only one piece, who sees the whole?

When Everyone Assumes Someone Else Checked
In a mature industry, a practice may be repeated by thousands of people who have no intention of breaking the law. Each may assume it was reviewed long ago because it is widespread.

That assumption can protect lawful practices from needless disruption. But it can also allow a harmful or unlawful practice to continue if nobody performs the underlying examination.

"Everyone does it" is neither proof of guilt nor a defense. The law still has to be applied to the facts.

The Role of a Whistleblower
Whistleblower programs exist because government cannot see every transaction from the outside. A whistleblower allegation is not a verdict. It is information asking government to determine whether further examination is warranted.

The author's IRS submissions do not establish violations merely because they were filed. An administrative closure likewise should not be confused with a judicial determination of every underlying proposition unless those merits were actually reached.

Respect Requires Accountability
Hospitals save lives. Doctors and nurses deserve respect. Accountability does not diminish that respect. Consistent enforcement can protect honest institutions and strengthen public trust.

Editor's note: This series distinguishes documented facts and established law from allegations, disputed interpretations and the author's proposed legal, tax and economic theories.

Artist Oscar Chan examines religion, myth and trauma in haunting Hong Kong exhibition

After artist Oscar Chan Yik-long left Hong Kong for Europe – first to Paris, then Helsinki – in 2019, he did not return to the city for many years. Widely considered one of Hong Kong’s most promising young talents, Chan even missed his 2021 solo exhibition – a display of the gothic, monochrome works he is best known for – at Gallery Exit in Aberdeen, Hong Kong, because he could not bring himself to board a long-haul flight. What kept him away was fear. At the time, Chan was suffering from severe...

After US midterms, how bitter political divisions eroded 4 Chinese dynasties

The recent American midterm elections offered yet another glimpse into a political culture increasingly defined by division and hostility. In the state of Ohio, Republican gubernatorial candidate Vivek Ramaswamy ran an attack advertisement against his Democratic rival, Amy Acton, exploiting painful details of her childhood. President Donald Trump publicly defended the advertisement. The episode was emblematic of a country where political conflict has come to reflect something far more profound...

Why minimalist skincare is replacing the 10-step routine

Some time in the last decade the bathroom shelf turned into a filing system. A cleanser for the morning and a different one for the evening; an acid on Tuesday, a retinol on Wednesday – and a barrier cream for the two nights afterwards, while your face recovers from the first two. But at some point, people started getting tired. Not of skincare exactly, but more of the admin: the cross-referencing, the percentages; the low-grade sense that there’s a step you’ve missed and a launch you haven’t...

GLP-1 side effects have users turning to supplements. Why doctors are worried

For 42-year-old Allison Vecchio, GLP-1 drugs were “a reset button on life”, but came at a price – with side effects like gastrointestinal distress, brittle nails and feelings of weakness so intense that at times she could not leave her bed. But Vecchio, an emergency room nurse based in Fort Pierce, in the US state of Florida, says the symptoms eased when she began a cocktail of supplements that included fibre, collagen and electrolytes, a haul that costs US$200 to US$300 a month. “You really...
